What is ELD?
An Electronic Logging Device is a DOT certified device which communicates with the truck’s engine to automatically record driving time, and records this electronically for authorities to view as needed, much like traditional paper logs. Commercial drivers who are required by law to keep hours-of-service records and record of duty status will now have to utilize an Electronic Logging Device (ELD) to record their hours-of-service record of duty status.
What Law Requires it?
To quote the Federal Motor Carrier Safety Administration: “Section 32301(b) of the Commercial Motor Vehicle Safety Enhancement Act, enacted as part of MAP-21, (Pub. L. 112-141, 126 Stat. 405, 786-788, July 6, 2012), mandates the ELD rule. It calls for the Secretary of Transportation to adopt regulations requiring ELD use in commercial motor vehicles (CMVs) involved in interstate commerce, when operated by drivers who are required to keep records of duty status (RODS).”
Who Must Comply with the Rule?
According to the FMCSA, the ELD rule is applied “to most motor carriers and drivers who are currently required to maintain records of duty status (RODS) per Part 395, 49 CFR 395.8(a). The rule applies to commercial buses as well as trucks, and to Canada- and Mexico-domiciled drivers.“ Essentially, all Commercial Motor Vehicles.
49 CFR 390.5 Commercial motor vehicle means any self-propelled or towed motor vehicle used on a highway in interstate commerce to transport passengers or property when the vehicle
(1) Has a gross vehicle weight rating or gross combination weight rating, or gross vehicle weight or gross combination weight, of 4,536 kg (10,001 pounds) or more, whichever is greater; or
(2) Is designed or used to transport more than 8 passengers (including the driver) for compensation; or
(3) Is designed or used to transport more than 15 passengers, including the driver, and is not used to transport passengers for compensation; or
(4) Is used in transporting material found by the Secretary of Transportation to be hazardous under 49 U.S.C. 5103 and transported in a quantity requiring placarding under regulations prescribed by the Secretary under 49 CFR, subtitle B, chapter I, subchapter C.
**If you are involved in intrastate commerce, you will need to check with your state authorities whether your state is adopting the ELD rule for intrastate commerce**
